Refund and Cancellation Policy


Effective Date: December 15, 2015

This Refund and Cancellation Policy (this “Policy”) incorporates all terms, conditions and policies on the Site and Services. You agree that by accessing, registering, signing up or using our Products and Services (including, but not limited to, our Site, mobile applications, platforms, Facebook, LinkedIn, Twitter) after the effective date will signify your acceptance of and agreement to this Policy.

Changes to the Refund and Cancellation Policy

To the extent permitted by law, we may modify this Policy without prior notice to you, and any revisions made to this policy will take effect once placed on this page, unless otherwise stated in a revised policy. Please check the Site regularly for any updates.

To request a refund or cancel an engagement, you must first fill out a Refund Request Form or an Engagement Cancellation Form on request from info@watchfit.com .The other party to the Engagement will then have 3 business days to either approve your request or submit a Dispute Notice Form. You must then follow the applicable process described below.

Description of Key Terms:

You must be aware of the following key terms for refunds or cancellations:

“Client” means a registered user who is able to publish Goals and purchase Expert Proposals on the WatchFit Site and Services.

“Expert” means registered professional from the health and fitness industry who is able to offer their services to Clients on the WatchFit Site and Services.

“Goal” is the option for a registered user (Client) to submit a request for services (Proposal) from a WatchFit Expert.

“Proposal” is the option for a registered Expert to offer a service in response to specific requirements of a Client who has published a Goal onto the WatchFit Site and Services.

“Engagement” is when a Client purchases a Proposal from an Expert, it is considered as a formal Engagement for which the Expert will be contracted to provide the terms of services as outlined in the Proposal.

“Terms of Services” means the requirements set out in the Engagement between Client and Expert.

Engagement Cancellation

If you submit an Engagement Cancellation Form, the following process will apply and the escrow will be locked:

  1. If the other party approves your request, then the Engagement is cancelled and you will be charged with cancellation fees.
  2. If the other party does not respond within an approval period of 3 business days following the submission of the Engagement Cancellation Form, WatchFit will notify the other party and request a response. If the other party does not respond to WatchFit, the Engagement will be cancelled and you will be charged with cancellation fees.
  3. If the other party submits a Dispute Notice Form during the approval period of 3 business days, then you are required to submit a Dispute Response Form in return within 3 business days of the submission of the Dispute Notice Form and (1) should you come to an understanding and agree with the other party, the Engagement will continue, or (2) should you disagree, WatchFit will provide notice to both parties to request that they mutually schedule a Dispute Assistance call.

Refund Request Form

Expert

If an Expert submits a Refund Request Form, the request is deemed approved and the Expert will be deemed to have issued the applicable Refund Escrow Instructions below.

Client

If a Client submits a Refund Request Form, then the following process will apply:

  1. If the Expert approves the Client’s request for a refund, then the Expert will have issued the applicable Refund Escrow Instructions below.
  2. If the Expert submits a Dispute Notice Form during the approval period of 3 business days, then the Client is required to submit a Dispute Response Form in return within 3 business days of the submission of the Dispute Notice Form and (1) should the Expert then approve the Client’s request for a refund, the Expert will have issued the applicable Refund Escrow Instructions below, or (2) should the Expert disagree, WatchFit will provide notice to both parties to request that they mutually schedule a Dispute Assistance call.
  3. If the Expert fails to submit a Dispute Notice Form within the approval period of 3 business days then the request is deemed approved and the Expert will be deemed to have issued the applicable Refund Escrow Instructions below.

Refund Escrow Instructions

By submitting a Refund Request form or approving a Client’s refund request, the Expert irrevocably authorises and instructs WatchFit as follows:

  1. If there is sufficient funds remaining in escrow to cover the amount of the refund requested or approved by the Expert, WatchFit will release the corresponding amount from escrow and deposit in the Client’s Account.
  2. If there is insufficient funds remaining in escrow to cover the amount of the refund requested or approved by the Expert, WatchFit will release to the Client (1) the amount remaining in escrow; and (2) the amount of the remaining balance of the refund from the Expert’s Account. If there is insufficient funds in the Expert’s Account to cover the full balance of the refund request, WatchFit will release the available funds from the Expert’s Account and deposit into the Client’s Account and pursue the Expert for the outstanding balance.
